Privacy Policy

BidMy Pty Ltd ("Bidmyloan") believes privacy is an important right of customers. Bidmy takes steps to protect your personal information from misuse and uses your information only in the ways described in this privacy policy. Bidmy is committed to complying with the National Privacy Principles (the "NPPs") as set out in the Privacy Act 1988.

The terms used in this Privacy Policy have the same meaning as they do in the Terms and Conditions for the use of the Website.

Personal Information

Bidmy only collects personal information where necessary to conduct our business and provide our customers with a high level of customer service. We collect personal information for the following purposes:

  • Provide products and services we offer
  • To pass your information to Lenders or other third parties (such as mortgage consultants) we deem appropriate
  • Decide whether to supply services to potential customers
  • To establish, provide and administer your relationship with us (including products and services provided to you)
  • To comply with laws which apply to us
  • To market our services
  • To respond to your queries

The types of personal information we collect includes, but is not limited to:

  • your e-mail address;
  • your contact phone number;
  • the purpose of the loan you are applying for;
  • the type of loan (eg refinance, new purchase etc);
  • how much money you would like to borrow;
  • how many borrowers there will be;
  • whether there will be a guarantor and the financial status of that guarantor;
  • whether you are borrowing as an individual, a company or a trust;
  • whether you are an Australian resident;
  • your year of birth;
  • your income;
  • your expenses;
  • whether you have any dependants;
  • your employment details (eg what type of employment, how long you have been employed etc);
  • whether you have a poor credit history or have any judgments recorded against you;
  • the details of the property or properties against which any loan may be secured;
  • where there is more than one intended borrower, which borrower has that security in his/her/its name;
  • your assets and liabilities;
  • whether you are eligible for a first home owner's grant;
  • what type of loan you are seeking (eg fixed term/line of credit, variable/fixed interest);
  • which features you are seeking with your loan (eg offset facility, internet banking, etc); and
  • which lenders you would like quotes from.

The only information you are required to provide in order to use the loan enquiry facility is:

  • your name
  • your address
  • your e-mail address;
  • your contact phone number
  • your year of birth
  • the purpose of the loan (eg principal residence, investment);
  • the type of loan (eg refinance, new purchase etc);
  • how much money you would like to borrow;
  • whether you are borrowing as an individual, a company or a trust;
  • whether you are an Australian resident;
  • the details of the property or properties against which any loan may be secured; and
  • whether you have a poor credit history or have any judgments recorded against you.

Unfortunately, if you do not enter the required information, you will not be able to use the loan enquiry facility.

If you choose not to enter the other optional information, you will still be able to use the service, but the loans that you are offered will not necessarily be as tailored to your needs as they otherwise may have been.

Cookies

We utilise "cookies" which enable us to monitor traffic patterns and to serve you more efficiently if you revisit the site. A cookie does not identify you personally but it does identify your computer. You can set your browser to notify you when you receive a cookie and this will provide you with an opportunity to either accept or reject it in each instance. If you reject a cookie, some of the parts or features of the Website may not function properly.

The loan enquiry system requires that your web browser accepts cookies, which are used to make logging-in possible, but these cookies are not used to collect, store, track or monitor any personal information. We also collect website statistics (which includes pages accessed and search terms used) but this information is not identifiable (i.e. we cannot tell who you are).

People under 18

We consider it is the responsibility of parents to monitor their children's use of our Website. Nevertheless it is our policy not to collect personal information from persons known to be under the age of 18 years or offer to send any promotional material to persons in that category.

We will use and disclose personal information for the primary purposes for which it was collected. We may also use and disclose personal information for purposes related or ancillary to the main reasons we collect it.

We may collect contact information (like e-mail addresses) from visitors to the Website. Unless you object, this information may be used:

  • to send news, information about our activities and general promotional material which we believe may be useful to you;
  • to monitor who is accessing the Website or using services offered on the Website; and
  • to profile the type of people accessing the Website.

If you wish to become a member of the Website, we will require you to provide us with the types of information listed above under "Collection". If you provide us with that information, we may pass it on to the Lenders or other third parties such as mortgage consultants we deem appropriate (in our absolute discretion). The primary purpose of collecting and passing on the information that you provide to us is to enable Lenders to:

  • understand the type of loan you are looking for;
  • assess your circumstances; and
  • potentially offer you a loan that will be best suited to your needs.

All the information that we collect (including your contact details and, if relevant, credit card details) is kept confidential to the best of our ability. You will appreciate, however, that we cannot guarantee the security of transmission.

From time to time, we may use the information in our possession to market services which may be of interest to you. In circumstances where we use your personal information in this manner, we will provide you with a right to choose whether or not to receive such information and marketing materials in the future.

If you request us not to use personal information in a particular manner or at all, we will adopt all reasonable measures to observe your request but we may still use or disclose that information if:

  • we subsequently notify you of the intended use or disclosure and you do not object to that use or disclosure;
  • we believe that the use or disclosure is reasonably necessary to assist a law enforcement agency or an agency responsible for government or public security in the performance of their functions; or
  • we are required by law to disclose the information.

We may also disclose your personal information on a confidential basis to:

  • Our related bodies corporate and other organizations (such as mortgage consultants) with whom we have alliances or arrangements, and their contractors and agents, who may contact you directly from time to time;
  • Suppliers of information technology services, so that they may provide those services; and

Our suppliers, contractors and agents for the purpose of providing services to us so that we can supply to you.

We keep your data as accurate, complete and up-to-date as possible. We make an effort to ensure this data is of high quality, but this relies on the accuracy and frequency of data provided by you and other third parties.

We take reasonable steps to protect your data from misuse and loss from unauthor ised access, modification or disclosure. This involves:

  • Non-disclosure - we do not disclose your personal information to other people or corporations in circumstances other than those described in this Privacy Policy.
  • Physical security - we've taken measures to prevent unauthorised entry to our premises and paper-based personal information.
  • Computer systems security - we've adopted measures to prevent unauthorised access and modification to your computer systems, databases and networks.

Bidmy also takes reasonable steps to destroy or permanently de-identify personal information which is no longer needed for the purposes described in this Privacy Policy.

You have the right of access to personal information Bidmy stores about you and your organisation. If you are of the belief that Bidmy holds personal information relating to you and you wish to obtain access to this information, please contact us on the details provided above in "Section 5 - Openness".

In the event that such a request is made, we will review our records to determine what personal information relating to you which we hold and endeavour to respond to your request as soon as possible, but in any event, within 21 days. We endeavour to ensure the person or company seeking access is indeed the person or company the information is about and, in this regard, we may request that identification is provided before the personal information is released.

Once we have notified you of the nature of the personal information relating to you which we hold, we will organise a time for you to view that information. However, in accordance with the Privacy Act, we may withhold some of the personal information which we hold in the following circumstances where Bidmy considers that:

  • in the case of personal information, providing access would pose a serious and imminent threat to the life or health of any individual; or
  • providing access would have an unreasonable impact upon the privacy of other individuals; or
  • the request for access is frivolous or vexatious; or
  • the information relates to existing or anticipated legal proceedings between Bidmy and you, and the information would not be accessible by the process of discovery in those proceedings; or
  • providing access would reveal the intentions of Bidmy in relation to negotiations with you in such a way as to prejudice those negotiations; or
  • providing access would be unlawful or the denying of access is required or authorised by or under law; or
  • providing access would be likely to prejudice an investigation of possible unlawful activity; or
  • providing access would be likely to prejudice the administration of the law and just ice; or
  • an enforcement body performing a lawful security function has asked Bidmy not to provide access to the information on the basis that providing access would be likely to cause damage to the security of Australia.

Bidmy does not levy a charge in respect of the making of a request for access to personal information held by Bidmy. However, Bidmy may charge you for the reasonable costs incurred by it in providing you with access to the personal information held.

We do not use Government identity numbers, such as tax-file numbers, to identify our clients or employees. We use the names and email address of those persons who enter information by way of the loan enquiry process.

In most circumstances, it is impractical for people to communicate with BidMy anonymously as we need to identify you or your company in each case to assist you effectively. However, in circumstances where it is lawful and practicable to do so, Bidmy will provide you with the option of not identifying yourself when entering into transactions with us.

Bidmy may send personal information overseas to Lenders that are based outside of Australia or Lenders that conduct any part of their business outside of Australia. The Terms and Conditions for the Website require you to consent to such a transfer of the information that you provide to us.

Bidmy does not collect sensitive information.
